Developers can now bypass Ku-ring-gai Council and have their proposals assessed by the NSW Housing Delivery Authority (HDA).

Friends of Ku-ring-gai Environment now knows of NINE State Significant Development Applications for Residential Flat Buildings:

• 3-9 Park Avenue, Gordon, 9 storey development + 100 apartments + 125 car spaces
• Burgoyne and Pearson Avenue, Gordon
• Woodside and Highgate Road, Lindfield, 173 apartments covering multiple sites
• 21-27 Roseville Avenue and 16-24 Lord Street, Roseville
• 2-8 Highgate Road, Lindfield – with Infill Affordable Housing
• 27-29 Tryon Road, Lindfield – with Infill Affordable Housing
• 12-16 Bent Street, Lindfield – with Infill Affordable Housing
• 59-63 Trafalgar Avenue 1A & 1B Valley Road, Lindfield
• 2, 4, 6, 8, 10, 12, 14 and 16 Pockley Avenue, Roseville – with Infill Affordable Housing

Ku-ring-gai Council is currently working with NSW Government on a suitable alternative scenario for the Transport-Oriented Development State Environment Planning Policy (TOD SEPP), that addresses Ku-ring-gai’s local planning principles as well as the dwelling numbers required by NSW Government under the TOD SEPP. This scenario is expected to go to public exhibition in March/April 2025 as per Council’s resolution in October 2024. Council is working to return to NSW Government by May 2025 as per our negotiated agreement with them.

Planning Minister Paul Scully has iterated in the press that the NSW Department of Planning, Housing and Infrastructure is working with Ku-ring-gai Council, and that whilst the TOD-SEPP has been gazetted, “the planning controls applicable to the Ku-ring-gai local government area in the transport-oriented development [state environmental planning policy] might change.

The current TOD-SEPP was gazetted in May 2024, and holds until Council and NSW Government agree on an alternative.

Ku-ring-gai Council has no influence over a developer that progresses a DA during this ‘transitional’ period through the State Significant Development Approval (SSDA) process. Applications lodged in this period will go through a ‘merit-based assessment’.

State Significant Development (SSD) proposals are now being lodged across Ku-ring-gai.

Development Applications for SSD will be processed and determined by the NSW Department of Planning, Housing and Infrastructure via the Independent Planning Commission (IPC).

Ku-ring-gai Council has no role in the processing of SSD Development Applications and does not hold any associated DA plans or documentation.

Once a SSD application is formally lodged, the NSW Department of Planning, Housing and Infrastructure will undertake the notification, assessment and determination of this and all other SSD applications. This includes notifying neighbours and receiving and considering all submissions made in respect of the application.

Ku-ring-gai Council’s role in this process is limited to being notified of any SSD application within its LGA and making a submission to the Department of Planning, Housing and Infrastructure, much like any other party that has been notified of the application. Council typically conducts and submits a comprehensive assessment referencing our local planning controls.
