Dear Mayor Kay,

We have noted your Media Release of 19 November 2025 and are extremely disappointed by Councillors voting unanimously to drop the legal challenge against the NSW Government.

The acceptance of several amendments including increased heights and densities and the deletion of 4 heritage items has been decided in private meetings with council and  the DPHI, with no public scrutiny or consultation. This is a breach of faith to Ku-ring-gai residents, particularly those residing in the TOD precincts.

We note that the statement that negotiations regarding the ‘saving’ of the currently lodged SSDs is continuing. Removing Council’s one key negotiating tool with the removal of the legal challenge does not make sense.

As all these SSDs, with the majority in LIndfield, do not meet the TOD Preferred Scenario, it is essential that all are refused. To cherry pick some and not others, while Council has objected to all in their submissions, would court community anger and possibly a challenge.

Agenda item GB16 TOD Alternative Plan being held in confidential without meeting the requirements of the Model Code of Meeting Practice and the Local Government Act needs urgent addressing.

We urge council to ensure all current SSDs are forced to comply with the exhibited TOD Preferred Scenario.
