Ku-ring-gai Council is inviting community feedback on the proposed minimum lot size for dual occupancy development.

Dual occupancy development refers to two dwellings built on a single lot of land, which may be attached or detached. To develop dual occupancy on a property, land must meet the proposed minimum lot size.

This page provides information about two options under consideration, Option A and Option B, and ways to provide your feedback, including an online survey and community information session.

Project details



To increase housing supply within NSW the NSW Government has required all councils to permit dual occupancy housing across all land zoned R2 (Low Density Residential), except for land that has bushfire risk, or a heritage item, or within a Transport Oriented Development area.

The NSW Government is giving 13 councils, including Ku-ring-gai, the opportunity to nominate a minimum lot size for dual occupancy development to manage the impacts of small lots sizes within established areas.

Council has developed two options for dual occupancy development that:

  • meet the NSW Government’s requirements to deliver dual occupancies on 50% of Council’s R2 (Low Density Residential) land; and
  • seek to manage impacts on Ku-ring-gai’s high quality garden character, including tall canopy trees and heritage conservation areas.



Local Housing Areas



The NSW Government has delineated draft Local Housing Areas around train stations and around Local Centres that have a large supermarket and facilities.

The Local Housing Areas are based on a 400m and 800m walking distance from the Centres. Currently detailed mapping of the Local Housing Areas has not been provided by the NSW Government.

As such we can only provide an indicative map of the draft Local Housing Areas.

In the Local Housing Areas the NSW Government will set a 450sqm minimum lot size and 12m lot width requirement for dual occupancy developments that arelodged via the development application process only.  These and other standards will be placed in the State Environmental Planning Policy (Housing) 2021. 

As part of this engagement process, and as outlined in the options below, Council is consulting on the minimum lot size for development applications outside Local Housing Areas and complying development applications across the council area.

A minimum lot width of 18m is proposed for lots developed via a development application outside a Local Housing Area.

Option A

Minimum lot sizes outside of NSW Government’s Local Housing Areas

Option A has one minimum lot size that applies across the Ku-ring-gai local government area (outside Local Housing Areas), for development applications and complying development applications.

This minimum lot size is 1,015 sqm with an 18m lot width and will apply in eligible R2 “Low-Density Residential” areas. 

Minimum lot sizes in the NSW Government’s Local Housing Areas

To develop dual occupancy within a Local Housing Area, the following minimum lot sizes will apply for each pathway:

  • complying development (set by Ku-ring-gai Council) – 1,015 sqm and 18m width
  • development application (set by NSW Government) – 450 sqm and 12m width

Positives:

  • Larger 1015 sqm minimum lot sizes across the whole local government area will enable better responses to streetscape and local character across Ku-ring-gai.

Negatives:

The new housing will not be placed close to shops and bus routes and therefore increase car reliance.

Option B:

Minimum lot sizes outside of NSW Government’s Local Housing Areas



Option B has two minimum lot sizes depending on the location of the property for both development applications and complying development applications in eligible R2 Low Density Residential areas.

The minimum lot size outside the five Neighbourhood Centres is 1,075 sqm with an 18m lot width.

In the five Neighbourhood Centre Areas below (within 400m walking distance) – the minimum lot size is 700 sqm with an 18m lot width.

  1. Hampden Ave, Nth Wahroonga
  2. Eastern Road, Turramurra
  3. Princes Street. Turramurra
  4. Kendall Street, West Pymble
  5. Wellington Road, East Lindfield

Minimum lot size in the NSW Government’s Local Housing Areas

To develop dual occupancy within a Local Housing Area, the following minimum lot sizes will apply for each pathway:

  • complying development (set by Ku-ring-gai Council) – 1,075 sqm and 18m width
  • development application (set by NSW Government) – 450 sqm and 12m width

Positives:

  • Smaller minimum lot sizes of 700 sqm within 400m walking distance of the five Neighbourhood Centres will place housing and new residents close to shops and bus routes.
  • Larger 1075 sqm minimum lot sizes across the majority of the local government area, better able to assimilate into the existing area character.

Negatives:

  • Smaller 700 sqm minimum lot sizes around the Neighbourhood Centres will result in loss of tree canopy and dense housing streetscapes within these centres.

Next steps

Using feedback from this process of consultation, Council will determine the most suitable approach and present our recommended option to the NSW Government.
