The Council’s alternative to the government’s transport-oriented development (TOD) policy was gazetted on Friday 14 November 2025. 

Gazettal of the Council’s alternative to the TOD policy is the culmination of more than 12 months of consultation and planning by the Council. The alternative plan was formally adopted by the Council in June 2025.

The NSW Government first introduced its TOD policy in Ku-ring-gai in May 2024.

Under the government’s policy, more than 20,000 new dwellings were expected to be built within 400 metres of Gordon, Killara, Lindfield and Roseville stations. 

In November 2024 the Council commenced community consultation on alternatives to the TOD policy for Roseville, Lindfield, Killara and Gordon, which would deliver the equivalent number of homes while preserving built heritage and protecting the tree canopy. 

Following community consultation, the Council adopted a preferred plan for new housing and submitted it to the NSW Department of Housing, Planning and Infrastructure (DHPI) with the aim of having it approved by the end of 2025.

Mayor Christine Kay said state government approval of the plan was after ‘detailed consideration by the Department’.

“Our plan has been substantively accepted by the government and delivers certainty for the people living in those suburbs affected by the TOD.”

“We are looking at the fine details of the approval and the maps accompanying the Council’s plan are attached to the Council report for next week’s meeting.”

The Mayor added that the Council would further consider the gazettal of its alternative plan at the 18 November 2025 meeting and a report on the Council’s legal action against the government would also be considered.

Ku-ring-gai Council will consider a confidential report at its meeting on 18 November 2025 regarding the legal action against the NSW Government that goes to court on 25-27 November 2025.

Affordable Housing Clause

Council’s proposed affordable housing clause was not included as part of the State Environmental Planning Policy Amendment (Ku-ring-gai Station Precincts) 2025. An affordable housing clause (Cl 6.14) was inserted into the KLEP by Ku-ring-gai Local Environmental Plan 2015 (Amendment No 40) on 24 October 2025. DPHI are currently preparing an amendment to the existing Cl 6.14 so that it references Council’s adopted Affordable Housing Contributions Scheme and applies within the TOD precincts.

Amendments to existing TOD maps

DPHI have made amendments to the existing TOD maps in SEPP housing to include 4 additional sites. This includes the Heritage items at 12 Stanhope Rd, Killara, 1 Valley Rd and 9 Middle Harbour Rd, Lindfield and 29 Roseville Ave, Roseville. No other amendments have been made to the existing maps meaning that the TOD controls will still continue to apply to the saved State Significant Development (SSD) sites.
