Submission of Objection: eDA0497/26
Property: 40–42 Wolseley Road, Lindfield NSW 2070
Proposal: Demolition of existing structures, site amalgamation, and construction of a residential flat building with basement car parking and associated works within a Heritage Conservation Area.
Dear General Manager,
I am writing to formally lodge my objection to development application eDA0497/26 for the proposed residential flat building at 40–42 Wolseley Road, Lindfield. While I acknowledge the need for diverse housing options across Sydney, the scale and nature of this specific proposal represent an unacceptable overdevelopment that will cause irreversible harm to the local environment and neighborhood character. [1]
I urge Council to refuse this application based on the following key town planning grounds:
1. Adverse Impact on the Heritage Conservation Area (HCA)
The subject site is located within a designated Heritage Conservation Area characterized by historically significant early Federation and Inter-War character homes. The wholesale demolition of the existing structures and the subsequent site amalgamation fundamentally disrupt the intact streetscape. The proposed residential flat building fails to respect or mirror the architectural rhythm, traditional building materials, and fine-grain residential fabric that Council’s heritage controls seek to protect. [1, 2]
2. Inappropriate Bulk, Scale, and Height
The proposed multi-storey residential flat building introduces an excessive visual bulk and scale that is completely out of character with the immediate context of Wolseley Road. The height and density of the structure fail to provide a sensitive transition to the surrounding low-density character dwellings, leading to severe visual dominance and an imposing street presence that diminishes the amenity of the public domain. [1]
3. Loss of Amenity, Privacy, and Overshadowing
Due to its substantial height and spatial footprint, the development will cause significant overshadowing to neighboring properties, restricting their access to solar energy and natural daylight. Furthermore, the multi-storey design introduces direct overlooking opportunities into the private open spaces and habitable rooms of adjacent low-density homes, severely compromising the acoustic and visual privacy of existing residents.
4. Traffic, Access, and Parking Congestion
Wolseley Road is a residential street that cannot safely absorb the cumulative traffic generated by high-density developments. The introduction of a basement car park for a large residential flat building will significantly increase vehicle trips, worsening traffic congestion during peak hours near the local school catchments and town center. The concentration of turning movements at a single access point also presents clear safety hazards for pedestrians and local motorists. [1, 2, 3]
5. Environmental Impact and Loss of Canopy
The removal of deep-soil planting zones due to the basement car park footprint restricts the opportunity to maintain and grow Ku-ring-gai’s signature high-quality tree canopy. This development threatens established mature vegetation and biodiversity on site, accelerating the urban heat island effect and contradicting Council’s public domain and green infrastructure objectives. [1, 2]
Conclusion
The proposal represents a severe departures from the Ku-ring-gai Local Environmental Plan (LEP) and Development Control Plan (DCP) regarding heritage conservation, density control, and neighborhood transitions. The negative impacts on heritage streetscape, local traffic, and residential amenity cannot be mitigated through minor architectural changes or conditions of consent.
I strongly request that Ku-ring-gai Council reject application eDA0497/26 in its current form. [1]
Thank you for considering this submission. I request to be notified of any future public meetings, planning panel reviews, or determinations regarding this matter.
Sincerely,
